The Pitfalls of Class Action Claims Administration and Notice

This course provides guidance on the most important claims administration and notice items to consider at the time of settlement negotiations. We will address how to avoid unexpected problems and surprise costs that can compromise or complicate a settlement.

Trends and Innovations in Class Action Claims Administration and Notice

This course addresses the changing landscape of class actions settlement administration, including CAFA requirements, data security and claims filing rates. We will also provide ideas on creative and cost-effective settlement structures, direct and media-based notice options and claims filing options.

Notice Methodology

This course provides an overview of F.R.C.P. Rule 23 notice requirements and the mechanics of paid media notice to unidentified class members. We will examine how notice plans are designed and measured to ensure adequate reach of class members through the targeting of specific demographic audiences.

Plain Language Notice

Revisions to F.R.C.P. Rule 23 now require notices to be written in “plain and simple language.” But plain language is not just the elimination of legalese – it’s the marriage of form and content to produce understandable notices that really communicate to a diverse audience. The dos and the don’ts of plain language are explained and illustrated.

CAFA – Notice Requirements

Defendants are now charged with providing notice to federal and state regulatory authorities within 10 days of filing a class action settlement with a court. Failure to provide notice to the proper agents allows class member opt-outs. Deadlines, requirements and extensive new obligations are outlined and discussed.
