Kinsella Media implemented the most comprehensive international class action notice program ever undertaken. The $125 million proposed settlement included compensation to rightsholders for books and other writings digitized as part of Google’s Book Search project. Notice to authors, publishers and heirs appeared in 72 languages in 214 countries and U.S. territories. Kinsella’s paid media campaign complemented an unprecedented direct notice program that Kinsella designed and executed with Rust Consulting. Kinsella researched the target audiences to create an expansive direct notice database, and worked with copyright rights organizations to distribute notice materials to hundreds of thousands of potential class members around the world. Kinsella also tracked global earned media and blog coverage of the settlement in order to provide the parties and the Court with the most complete picture possible of information being publicly distributed about the settlement. While the settlement did not receive final approval, the court did not sustain any notice-related objections.
In re International Air Transportation Surcharge Antitrust Litigation

This case, involving allegations that consumers were overcharged on the purchase price of their airline tickets for travel between the United States and the United Kingdom, was one of the first class action lawsuits to be publicized in the U.K. Due to the fact that the British audience was relatively unfamiliar with class action lawsuits and class member rights, Kinsella Media determined it was necessary to implement a robust paid media program. Kinsella placed advertisements in numerous national newspapers across the U.K., travel and in-flight magazines and travel websites, such as Expedia.com and LastMinute.com. Additionally, a simultaneous national U.S. notice program incorporated national consumer magazines, travel magazines, newspaper supplements and Internet banner advertising on Expedia.com.
Currie v. McDonald’s Restaurants of Canada Limited

The notice programs in this case targeted McDonald’s customers in Canada who obtained a promotional game piece. Kinsella Media implemented two separate notice programs: first the notice of class action settlement, and then the notice of certification and approval of class action settlement. Both notice programs incorporated consumer magazines, national newspapers and provincial newspapers.

Notice appeared in 34 languages in the international editions of five newspapers and consumer publications and 159 newspapers in 58 countries and U.S. territories.
